While X filled up with joke “confessions” of thousands of fake ballots, real people with green cards were answering for votes cast years ago.
Why it matters: One wrong checkbox at the DMV can cost a green card holder citizenship — or their right to stay.
Driving the news
- DHS Secretary Markwayne Mullin warned that noncitizens who voted illegally will be “hunted down” and prosecuted (The Hill). ICE’s own message: “There will be no escape.”
- ICE said it had no plans to send agents to polling places; federal law bars armed federal personnel there (NPR, The Hill).
- Mullin reportedly said DHS would review voting data after the midterms — known from secondhand summaries only.

The cases (charges, not convictions — everyone is presumed innocent)
| State | Who | Alleged | Source |
|---|---|---|---|
| Tennessee | French and Iraqi nationals, arrested Oct. 29 | voting by aliens, believed in the 2024 election | ICE |
| Oklahoma | Philippine citizen, lawful permanent resident, arrested Oct. 28 | falsely claimed citizenship to register in 2022 and voted; her naturalization application was pending | ICE |
| New Jersey | two Passaic County men, 54 and 72 | voting in federal elections as noncitizens; false statements on citizenship applications | US Attorney’s Office (DOJ), NJ.com |
Per ICE, one New Jersey defendant allegedly voted over a 22-year span; prosecutors say the other voted in 2014, 2016, 2020 and 2024.
Between the lines: Many get caught when they apply for citizenship. The naturalization form asks directly whether you’ve ever registered or voted.
What it means for immigrant families
- The DMV. You may be offered voter registration when getting a license. Never check “I’m a citizen” — not even “just in case.”
- Petition tables. Volunteers outside the supermarket don’t check status. The responsibility is yours.
- Local elections. A few cities let noncitizens vote in certain local races. Federal elections: never.
- Registered by mistake? Don’t vote, and see an immigration attorney before you file for citizenship.
The big picture: politics
Noncitizen voting is a favorite GOP theme — “Save Act” and “Save America Act,” the proof-of-citizenship bill, are trending on X again. Democrats say cases are rare and accuse the administration of intimidating immigrants.
Our view
We think two things need separating. Noncitizen voting breaks the law, and protecting citizens’ votes is a normal position, not “repression.” But Election Day vows to “hunt down” people also work as a political signal — and they mostly frighten people who did nothing wrong. Our advice: don’t play with forms. One wrong checkbox can cost you an American passport.
